I. INTRODUCTION

CAMARONVISION S.L. reserves the right to modify this Policy in order to adapt it to new legislation, jurisprudential criteria, sector practices, or the interests of the company. Any modification in the same will be announced with due notice, so that you are fully aware of its contents.

In order to provide you with certain services it is necessary to manage your personal data. For these purposes, your personal data will be incorporated into the corresponding processing activities of CAMARONVISION S. L and will be processed for the specific purpose of each treatment, in accordance, mainly, with the regulation established by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) and the Organic Law 3/2018 of 5 December on the Protection of Personal Data and guarantee of digital rights (LOPD-GDD).

2. What do we process your personal data for?
CAMARONVISION will process the information provided by the USER for different purposes, depending on the way the data is collected:
  • To manage the contractual or commercial relationship established between CAMARONVISION and the USER.

  • To provide the services requested by the USER.
    To manage the candidatures in the personnel selection processes if the USER registers for job offers through this WEBSITE.

  • Manage, administer, provide, expand and improve the newsletter services or information on Visionlab products to which the USER has decided to subscribe or register.

  • Conduct quality surveys on Visionlab products or services.

  • Conduct surveys on tastes or trends to users in order to obtain information in order to design new services related to the above.

  • Conduct statistical studies to design improvements in the services provided.

  • Send information requested by the USER or to which the USER has subscribed (e.g. Newsletter).

  • Send information about modifications in the products or services contracted by the USER.

  • Send information about new products or services in the optical and audiometric sector, similar to those originally contracted or which may be of interest to the USER by any means, including electronic means, even when the commercial relationship established between CAMARONVISION and the USER ends.

3. Mandatory or optional nature of the information requested
The mandatory data of each form will be identified as such in the form itself.

The refusal to provide such information will prevent the service requested by the USER from becoming effective.

 

4. How long do we keep your personal data?
The personal data provided will be kept for the period of time necessary to manage your query, suggestion, complaint or claim, as well as for the provision of the requested service or the development of the contractual relationship established between you and CAMARONVISION. Once the same has been terminated, they will be kept for the corresponding term to comply with legal obligations or for the term that a judge or court may require it. In the case of subscriptions to electronic newsletters, the data will be processed as long as you do not revoke your consent or object to the processing. In relation to the sending of curricula, it will be processed for two years unless you revoke consent or object to the processing.
 

5. What is the legal basis that legitimizes the processing of your personal data? That is to say, what is the legal basis that allows us to process your personal data?
The legal bases that legitimize us to process your personal data are the following:

The performance of a contract to which you are a party.

The consent given by you by signing or accepting the relevant forms, for one or more specific purposes.

In the event that consent is the basis that legitimizes the treatment, it may be revoked through an email to the address camaronvision@hotmail.com, identifying yourself as a USER of the WEBSITE and specifying your request or, where appropriate, through the marking of the box provided for that purpose in the form itself.

 

6. Who may be assignees or recipients of your personal data?
Personal data will not be transferred or communicated to third parties, except in the cases necessary for the development, control and fulfillment of the purpose/s expressed, in the cases provided by law.
 

7. Commitments of the USER - Who must keep the data updated?
On the other hand, in order that the data contained in our files, computer and/or paper, always correspond to reality, we will try to keep them updated. Therefore, for this purpose, the USER must make the changes, directly, when so enabled, or by communicating, by reliable means, to the corresponding area or department of CAMARONVISION S.L.

The USER guarantees that he/she is over 14 years of age and that the information provided is accurate and truthful.

The USER undertakes to inform CAMARONVISION of any modification to the information provided by sending an e-mail to the address camaronvision@hotmail.com , identifying himself/herself as USER of the WEBSITE and specifying the information to be modified.

Likewise, the USER undertakes to keep the passwords and identification codes secret and to inform CAMARONVISION as soon as possible in the event of loss, theft or unauthorized access. Until such communication is made, CAMARONVISION shall be exempt from any liability that may arise from the improper use of such passwords and identification codes by unauthorized third parties.

8. Data of third parties provided by the USER
In the event that the USER provides personal data of third parties for any purpose, the USER guarantees to have previously informed the affected parties and to have obtained their consent for the communication of their data to CAMARONVISION.

The USER guarantees that the persons concerned are over 14 years of age and that the information provided is accurate and truthful.

CAMARONVISION will verify the consent of said affected parties by means of a first e-mail with non-commercial content, requesting the verification of the consent given on their behalf by the USER.

In the event of any liability arising from a breach of these conditions by the USER, he/she shall be liable for the consequences of such breach.

CAMARONVISION S.L. will adopt the appropriate technical and organizational measures in its information system, in compliance with the principle of proactive responsibility, in order to guarantee the security and confidentiality of the stored data, thus avoiding their alteration, loss, unauthorized processing or access, taking into account the state of the art, the costs of application, and the nature, scope, context and purposes of the processing, as well as risks of varying probability and severity associated with each of the processing operations.

However, the USER should be aware that Internet security measures are not impregnable.

11. What are your data protection rights and how can you exercise them?
You may exercise your rights of access, rectification, suppression, limitation, portability or, if applicable, opposition. For these purposes, you must submit a written document to CAMARONVISION S.L. C/Andalucia 3, 28760 Tres Cantos, Madrid or send it to the e-mail address of our DPD: camaronvision@hotmail.com. En. The written document must specify which of these rights you request to be satisfied and, at the same time, you must show or, in case of postal delivery, attach a photocopy of your ID card or equivalent identification document. In case of acting through a representative, legal or voluntary, must also provide a document proving the representation and identification document of the same. 1. a) What are my rights?
The data protection regulations allow you to exercise your rights of access, rectification, opposition, portability, erasure (“right to be forgotten”), restriction of processing and the right not to be the subject of individualized decisions, in accordance with the EU Regulation. When the processing of your data is based on consent or is necessary for the performance of a contract or pre-contract and is carried out by automated means, you have the right to the portability of your data, i.e. to have it delivered to you in a structured, commonly used and machine-readable format, including forwarding it to a new controller, which is why CAMARONVISION S.L. will facilitate the portability of your data to the new controller.

You, as the data subject or holder of the personal data, acting on your own behalf and in your own right.

Through another person acting, duly accredited, as legal representative (e.g. when the holders of parental authority or guardianship act on behalf of a person under 14 years of age or when acting as legal representative of a person with functional diversity) or volunteer (person you have freely and voluntarily granted powers of attorney for this purpose).

By postal mail

In both cases, you must:

  • Provide sufficient data and information to meet the request. For this purpose, you may use the model forms made available by the Spanish Data Protection Agency https://www.aepd.es/es/derechos-y-deberes/conoce-tus-derechos.

  • Sign the form by handwriting or, if applicable, and if you have a recognized digital certificate, sign it electronically.

  • Attach a photocopy of ID card, passport, NIE or other equivalent identification document. In case of acting on behalf of a third party, a copy of your ID card or equivalent identification document must also be included, as well as the document accrediting the representation of the interested party.

  • Send the form and documents proving your identity by any of the aforementioned means.

CAMARONVISION S.L. will analyze whether or not the petition is in accordance with the law. CAMARONVISION S.L. will inform the petitioner of the decision taken, proceeding accordingly: if the petition is upheld, it will adopt the appropriate measures according to the right exercised; if it is rejected, it will indicate the system of appeals provided for by law. In case the requests are manifestly unfounded or excessive (e.g. repetitive nature) CAMARONVISION S.L. will be able to: (i) Charge a fee proportional to the administrative costs borne (ii) Refuse to act.
